TRAP Clauses: The Hidden Debt in Training Agreements

By Nina Kowalski • January 3, 2026 Employment

You got the job offer. The salary is decent, and they're even going to train you. But buried in your employment agreement is a clause that could cost you $10,000 or more if you leave within the first few years. Welcome to TRAP clauses.

What is a TRAP Clause?

Training Repayment Agreement Provisions (TRAPs) make you pay back training costs if you leave before a set time. These clauses have become far more common. Some estimates say 10% of American workers are now locked in by them.

How TRAPs Work

A typical TRAP clause says that if you quit (or get fired for a specific reason) within 1-3 years, you have to pay back:

Real Example: Nursing Industry

A hospital offers new nurses a "training program" that's essentially orientation. If the nurse leaves within 2 years, they owe:

$15,000 - $30,000

This amount often exceeds what the training actually cost the employer.

Industries Where TRAPs Are Common

What Makes a TRAP Illegal?

Some states have banned or restricted TRAPs:

Even in states without bans, TRAPs may not hold up in court if:

  1. The training mainly helps the employer (and does not give you useful skills elsewhere)
  2. The payback amount is more than what the training actually cost
  3. You were fired without cause but still required to pay
  4. The repayment period is unreasonably long

Red Flags to Watch For

  • A payback amount that does not shrink over time
  • Vague "training" that's really just normal onboarding
  • Repayment required even if you're laid off
  • Interest charges on the repayment amount
  • Wage deductions for repayment (often illegal)

Before You Sign

  1. Ask for specifics: What exactly does the "training" include? What are the actual costs?
  2. Negotiate the terms: Ask for the amount to shrink over time, a shorter payback period, or a rule that you owe nothing if they fire you
  3. Check your state: Find out if TRAPs can be enforced where you live
  4. Get it in writing: Any verbal promises about waiving the TRAP should be documented
